1. Acceptance of Terms

By downloading, installing, or using Slouch AI ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and False Summit Solutions LLC ("Company," "we," "us," or "our") regarding your use of the App.

2. Description of Service

2.1 Core Features

Slouch AI provides:

• AI-powered posture analysis using photos captured by your device camera
• Real-time posture monitoring using compatible AirPods (AirPods Pro, AirPods Max, AirPods 3rd generation)
• Personalized exercise recommendations
• Progress tracking, streaks, and analytics
• AI coaching conversations
• Posture check-in reminder notifications
• Cloud data synchronization when signed in

2.2 Service Availability

The App is currently available for iOS devices. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

2.3 AI-Powered Features

Slouch AI uses artificial intelligence services (including OpenAI and Anthropic) to analyze posture images and provide coaching. AI-generated content is provided for informational purposes and should not be considered professional medical advice.

3. Subscription and Payment

3.1 Pricing

• Free Tier: Limited daily posture checks and basic features
• Premium Subscription: Unlimited tracking and access to all features

3.2 Billing

• Subscriptions are billed through the Apple App Store
• Prices may vary by region and are subject to change
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period

3.3 Cancellation

• Cancel anytime through your Apple ID account settings
• No refunds for partial subscription periods
• Access to premium features continues until the end of the current billing period

3.4 Free Trial

We may offer a free trial period. If you do not cancel before the trial ends, you will be automatically charged for the subscription at the then-current price.

4. User Accounts

4.1 Account Creation

• You may use the App without creating an account, but some features require sign-in
• When you sign in with Apple or Google, your data is automatically synchronized to our cloud servers
• You are responsible for maintaining the security of your account
• One person per account (no account sharing)

4.2 Age Requirements

• You must be at least 13 years old to use the App
• Users under 18 should have parental consent

4.3 Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the service or attempt to circumvent usage limits

5. Acceptable Use

5.1 You agree NOT to:

• Use the App for any illegal purpose
• Attempt to hack, reverse engineer, or modify the App
• Share your account credentials with others
• Circumvent subscription requirements or usage limits
• Interfere with the App's normal operation
• Upload inappropriate, offensive, or illegal content for AI analysis
• Use the App to generate content that violates third-party rights

5.2 Health and Safety

• The App provides general posture guidance, not medical advice
• Consult healthcare professionals for medical concerns or persistent pain
• Stop using the App if you experience pain or discomfort during exercises
• Follow exercises and recommendations at your own risk

6. Intellectual Property

6.1 Our Property

All content in the App, including but not limited to software code, algorithms, design, user interface, exercise content, trademarks, and logos, is owned by or licensed to False Summit Solutions LLC and is protected by intellectual property laws.

6.2 Your Content

• You retain ownership of photos you capture for posture analysis
• By using the App, you grant us a license to process your photos through our AI services for analysis
• Photos are processed but not permanently stored (see Privacy Policy)
• You retain ownership of your posture data and can delete it at any time

6.3 Feedback

Any feedback, suggestions, or ideas you provide may be used by us to improve the App without compensation or attribution.

7. Privacy and Data

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

7.1 Data Collection

• We collect posture check-in data, exercise completion data, and profile information
• Photos captured for posture analysis are sent to our servers and AI services but are not permanently stored
• Usage analytics and crash reports are collected to improve the App

7.2 Data Synchronization

• When you sign in, your data is automatically synchronized to our cloud servers
• This enables access to your data across devices and prevents data loss

7.3 Camera and Motion Access

• The App requires camera access for posture photo analysis
• The App requires motion permission for AirPods posture monitoring
• You can revoke these permissions at any time through device settings

7.4 Advertising and Tracking

• We use Meta (Facebook) SDK to measure advertising effectiveness and optimize ad campaigns
• When you first open the App, you will be prompted to allow or deny tracking via Apple's App Tracking Transparency framework
• If you allow tracking, your device identifier and purchase events may be shared with Meta for advertising purposes
• You can change your tracking preference at any time in your device's Settings under Privacy & Security → Tracking
• Denying tracking does not affect core app functionality

8. Disclaimers and Limitations

8.1 Medical Disclaimer

SLOUCH AI IS NOT A MEDICAL DEVICE OR SERVICE. The App:

• Does not provide medical advice, diagnosis, or treatment
• Should not replace professional healthcare consultation
• Is for informational and general wellness purposes only
• May not be accurate for all body types or conditions

8.2 AI Disclaimer

AI-generated posture analysis and recommendations:

• Are provided by third-party AI services (OpenAI, Anthropic)
• May contain errors or inaccuracies
• Should be verified by qualified professionals for medical decisions
• May vary in quality based on image quality and other factors

8.3 Service Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of AI-generated content
• Uninterrupted or error-free operation

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the App in the past 12 months
• We are not responsible for third-party services (including AI providers and advertising partners), their outputs, or content
• We are not liable for any health issues arising from following App recommendations

9. Indemnification

You agree to indemnify and hold harmless False Summit Solutions LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit for AI analysis

10. Changes to Terms

• We may modify these Terms at any time
• Changes will be posted on this page with an updated effective date
• Continued use of the App after changes constitutes acceptance
• Material changes will be notified through the App

11. Governing Law and Disputes

11.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

11.2 Dispute Resolution

• We encourage resolution through direct communication first
• Any disputes shall be resolved through binding arbitration
• You waive any right to participate in class action lawsuits

11.3 Jurisdiction

For any matters not subject to arbitration, you consent to exclusive jurisdiction in the courts of Delaware.

12. Severability

If any provision of these Terms is found unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and False Summit Solutions LLC regarding the use of Slouch AI.
